Access to and use of the Website, as well as the placing of purchases through the online store, are governed by these Terms of Use, which apply as they stand. Browsing and using the Website entail the unreserved acceptance of these Terms by the visitor/user.

1. Disclaimer of Liability

The Company takes every necessary measure to provide users with a secure environment, as well as valid, reliable and up-to-date information. However, each user remains responsible for assessing the accuracy of the posted content, regardless of whether it consists of information provided by the Company itself or by third parties.

The Company makes reasonable efforts to maintain the Website and ensure its availability, and reserves the right to modify and/or suspend, temporarily or permanently, all or part of it, with or without prior notice to users, given that availability may be affected by users’ equipment and software, by other communication networks, by a large number of persons attempting simultaneous access, or by other causes. Consequently, the Company bears no liability for any damage arising from users’ inability to access the Website, from the discontinuation of all or part of it, from delay, non-delivery, interruption or poor quality of reception of its services, from the loss of its content, or from the existence of errors of any kind. In any event, the Company reserves the right to suspend at any time, temporarily or permanently, the operation of all or part of the Website for reasons of maintenance, upgrading or for any other reason.

The user acknowledges that communications over open networks are exposed to numerous threats that render them insecure, and that it is incumbent upon the user to take all necessary technical measures to adequately control them — including, among others, maintaining up-to-date systems for detecting malicious software (viruses, trojans, etc.), as well as keeping the security updates (patches) of the respective browsers current.

Accordingly, the Company undertakes no commitment and bears no liability for any risk or damage (direct or consequential) that the user may suffer from the use of the Website and its content.

2. Third-Party Websites

The Website may provide hyperlinks to third-party websites or applications. The Company bears no liability for any damages that may arise from users’ browsing of third-party websites/applications, as users remain solely responsible for evaluating and using their content. The Company reserves the right to remove the relevant links from the Website at any time, at its discretion.

3. Intellectual and Industrial Property – Prohibition of Republication

The entire content of the Website, including indicatively the information, services, distinctive titles, trademarks, images, graphics, photographs, designs, texts, product descriptions and technical specifications, etc., constitutes the intellectual and industrial property of the Company and is protected by the Greek and European Union regulatory framework on intellectual and industrial property, as well as by the relevant international conventions. Likewise, the corporate name, the images, the graphic design (look & feel), the underlying programs (including source code), the logos and the distinctive features included in the Website constitute assets of the Company and are protected by the relevant trademark legislation.

It is noted that certain trademarks, product names and logos of third-party software manufacturers or technology providers that may appear on the Website belong to their respective right holders and are used exclusively for the purposes of describing and promoting the products and services offered.

In any event, the display and presentation of the above content on the Website shall in no way be construed as a transfer or assignment of a licence or right of use thereof. Any copying, digital recording, mechanical reproduction, transfer, downloading, resale or creation of derivative work based on said content is prohibited, as is misleading the public as to the actual provider/operator of the Website. The reproduction, republication, uploading, announcement, dissemination, transmission or any other use of the content, by any means or manner, for commercial or other purposes, is permitted only with the prior written consent of the Company or of any other lawful holder of the relevant rights.

4. Products, Services, Orders and Prices

Through the Website, the Company presents and offers the artificial intelligence and data analytics services and solutions it provides (indicatively: development of customised AI models, RAG systems, Vision AI and Edge AI solutions, Big Data services), as well as any related software or subscription services.

The Company makes every possible effort to ensure that the information, photographs, technical specifications and prices of the products are accurate and up to date. However, it is not liable for any technical or typographical errors made inadvertently or due to interruptions in the operation of the Website. Product images are indicative in nature.

Product prices are stated in euro (€) and, unless otherwise specified, include the applicable VAT. The Company reserves the right to change prices at any time without prior notice; the applicable price is the one displayed at the time the order is completed. Any shipping costs are calculated and displayed separately before the order is finalised.

The submission of an order by the user constitutes an offer to conclude a contract of sale. The contract is deemed concluded upon the Company sending a relevant confirmation accepting the order. The Company reserves the right not to accept or to cancel an order in the event of product unavailability, incorrect price display or inability to verify the customer’s identity, informing the user accordingly and refunding any amount paid.

5. Payment Methods

Orders are paid using the payment methods described on the Website during the checkout process (indicatively: debit/credit card through the secure environment of a partner payment service provider, bank deposit/transfer, etc.). Card transactions are processed through a certified payment service provider, in a secure encrypted environment; the Company does not store card details.

6. Shipping and Delivery

Products are shipped via partner courier/transport companies, within the timeframes stated on the Website or agreed with the customer. The stated delivery times are indicative and may vary due to availability, the particular characteristics of the equipment, or reasons of force majeure. The risk of accidental destruction or deterioration of the product passes to the customer upon delivery to them. Upon receipt, the customer must check the integrity of the packaging and of the product.

7. Right of Withdrawal and Returns

A customer who is a consumer has the right to withdraw from the distance contract without giving any reason within fourteen (14) calendar days from receipt of the product, in accordance with Law 2251/1994 and Directive 2011/83/EU, as in force. To exercise this right, it is sufficient to send a clear statement to that effect to the Company (e.g. at info@deepnexus.gr) before the expiry of the above deadline.

In the event of withdrawal, the product must be returned in the condition in which it was received, complete and undamaged, together with all its accessories and packaging. The Company refunds the price within the statutory deadline, while the return costs are borne by the customer, unless otherwise specified. The right of withdrawal does not apply to the exceptions provided for by law (indicatively, to products manufactured or configured according to the customer’s specifications or clearly personalised, as well as to services that have been fully performed with the customer’s express consent).

Irrespective of the right of withdrawal, the provisions on the statutory guarantee and the seller’s liability for defects and lack of agreed qualities apply.

8. Warranty

Products are accompanied by the respective manufacturer’s warranty of proper operation, as described in the accompanying documentation, as well as by the statutory guarantee provided for under the applicable consumer protection legislation. The terms, duration and coverage of each warranty depend on the manufacturer and the specific product.

9. Appointment Bookings and Electronic Communication

Where the Website provides the option to book appointments or submit requests through electronic forms, the user must provide accurate and up-to-date details. The processing of such details is governed by the Company’s Personal Data Protection Policy.

10. Personal Data Protection Policy

The Company collects and further processes users’ personal data during their visit to the Website and when making purchases, in accordance with national and European Union personal data protection legislation and, in particular, with Regulation (EU) 2016/679 (hereinafter the «GDPR»), Law 4624/2019, Law 3471/2006, the relevant case law of the Court of Justice of the European Union, as well as the acts (Decisions, Directives and Opinions) of the Hellenic Data Protection Authority. 11. User Obligations

All users are required to use the Website in accordance with these Terms of Use, as well as with the rules of good faith and public decency, as derived from the Greek, European Union and international regulatory framework. In the event of a breach of the obligations set out below, users are required to compensate the Company for any damage it may suffer. In particular, users are required:

  • To use the content of the Website in a manner that does not infringe the rights of third parties (individual and social), does not offend personality, and does not contravene the law and public decency or commercial practice.
  • Not to mislead anyone as to the origin of the Company’s content and not to harm its reputation in any way.
  • To provide true, accurate and up-to-date details when submitting an order or a request.
  • Not to install, promote or make available content containing viruses or any other electronic code, files or programs designed to interfere with, destroy or limit the operation of any software, or to prevent other users from using the Website.

Should a user breach, in any way, the content of these Terms of Use, the Company reserves the right to restrict, suspend or terminate their access to the Website, adopting every measure necessary for that purpose.

12. Dispute Resolution

These Terms of Use are governed by Greek law. Should a dispute arise with a user of the Website, the Company will seek to resolve it amicably. If this is not possible, the courts of Xanthi shall have jurisdiction to resolve the dispute.

In addition, in accordance with European Union legislation, consumers have the option of online resolution of consumer disputes through the European Commission’s Online Dispute Resolution (ODR) platform, at https://ec.europa.eu/consumers/odr.

Should any Term be found invalid, its invalidity shall not entail the invalidity of the remaining Terms of Use.

13. Amendment / Updating of the Terms of Use

The Company reserves the right to unilaterally amend these Terms of Use at any time, in the context of its compliance with regulatory changes, the upgrading of its functions and the optimisation of its services. The Terms of Use in force at any given time are those posted on the Website.
